Basics of Representing Abused & Neglected Children

Immigration and Nevada’s Criminal Statutes: Implications for Plea Negotiations

Course description: The U.S. Supreme Court’s call for more creative plea bargaining in criminal cases involving noncitizens (Padilla v. Kentucky) requires specific understanding of how each state’s criminal laws interact with federal immigration law. The purpose of this CLE is to give Nevada judges, prosecutors, and defense attorneys an introduction to how immigration concerns might influence plea negotiations in Nevada. This CLE will give a brief overview of the immigration system. It will introduce the main principles that determine whether state criminal convictions will have immigration consequences for noncitizens, and will illustrate how these principles apply to commonly charged nonviolent crimes under Nevada law. Particular focus will be paid to offenses such as petit larceny, burglary and drug possession. The CLE will focus on the particular needs for client counseling that noncitizen defendants may face in these cases.

Family Law: Domestic Rule Changes (16.2 & 16.205)

Course description: Considering the changes to discovery procedures contained in NRCP 16.2 (Divorce, Annulment, Separate Maintenance and Domestic Partnerships) and NRCP 16.205 (Paternity and Custody Matters), Judges Hoskin and Duckworth offer a view from the bench on how these rules change and/or simplify the family law discovery process. The Judges will present an overview of both rules and the detailed and general financial disclosure forms, as well as their opinions on how best to utilize them. Precision Focus Groups: A Valuable Tool in Trial Preparation

Speaker: Allen Lichtenstein, Esq.

Course Description: Focus Groups can be of value from an initial assessment of a potential case, to evaluate how jurors might assess the attorneys, witnesses, evidence, and arguments you plan to present. This seminar will elaborate these aspects and will include a demonstration.

Topics:

  • Initial assessment of a potential case—uncover aspects that could make a case undesirable.
  • Perception of the attorneys—what might be the best demeanor for the case?
  • Perception of the witnesses—are they believable?
  • Perception of the defendant / plaintiff—are they likable or sympathetic?
  • Perception of the evidence—how do different people react to the same thing?
  • Perception of the argument—when there are holes, does the jury fill them in with assumptions?
  • Format of the precision focus group—case information, deliberation, questionnaire, debriefing, Q & A’s.
  • Demonstration of how a precision focus group works.
